Published on July 17, 2026, the new regulation ends the long-standing "duration of status" (D/S) framework and replaces it with fixed admission periods. This change, scheduled to take effect on September 15, 2026, represents one of the most substantial shifts in U.S. immigration policy in recent decades, requiring a more proactive approach to status management for thousands of global residents and investors.
A New Era of Oversight: Replacing Duration of Status (D/S)
For years, F (academic students), J (exchange visitors), and I (foreign media) visa holders enjoyed a flexible admission known as "duration of status," which allowed them to stay in the U.S. as long as they maintained their program requirements. Under the final rule, this flexibility ends. Starting September 15, 2026, Customs and Border Protection (CBP) will no longer issue D/S on Form I-94. Instead, every entrant in these categories will receive a specific "Admit-Until Date" (AUD).
For F-1 students and J-1 exchange visitors, the maximum initial admission period will now be capped at four years, or the length of their program, whichever is shorter. For I visa holders representing foreign media, the admission period is limited to 240 days, with a further restriction of 90 days for passport holders from the People’s Republic of China (PRC).

Key Provisions You Need to Know
The transition to fixed admission periods introduces several critical administrative changes that you must prepare for immediately:
- Fixed Admission Caps: F and J admissions are capped at a four-year maximum. Even if your academic or research program is intended to last longer, you will now be required to apply for an extension to stay beyond the initial four-year mark.
- Reduced Grace Periods: The grace period for F-1 students to depart the U.S. or transition to a new status after program completion has been reduced from 60 days to 30 days. This half-reduction makes early planning more essential than ever.
- Mandatory Extension Filings: To stay beyond your "Admit-Until Date," you must now file Form I-539 (Application to Extend/Change Nonimmigrant Status) with USCIS. These extensions are not automatic and will be adjudicated on a case-by-case basis, requiring filing fees and biometrics.
- New Transfer Restrictions: The rule introduces stricter limitations on school transfers and changes in educational levels, aiming to ensure that the primary purpose of the stay remains consistent with the original visa intent.
Navigating the Transition for Current Status Holders
If you are already in the U.S. under "Duration of Status" when the rule takes effect on September 15, 2026, you generally do not need to take immediate action. However, your stay will be subject to a new transition limit: you may remain until the end date on your current I-20 or DS-2019, or for a maximum of four years from the effective date, whichever comes first.
Crucially, any travel outside the U.S. after September 15 will subject you to the new rules upon reentry. You will be admitted with a fixed date, regardless of your previous D/S status.

Secondary Update: Rescission of the 2022 Public Charge Rule
In addition to the visa admission changes, DHS has also finalized the rescission of the 2022 public charge regulations, effective September 18, 2026. This shift returns USCIS adjudicators to a broader "totality-of-the-circumstances" standard. After this date, officers will have greater discretion to consider a wider range of means-tested public benefits when determining a person's eligibility for admission or adjustment of status.
