The Department of Homeland Security (DHS) has published a final rule rescinding the 2022 public charge regulations. Effective September 18, 2026, U.S. Citizenship and Immigration Services (USCIS) officers will apply a broader "totality-of-the-circumstances" standard when determining whether an applicant is likely to become a public charge.
The final rule removes the 2022 framework that had limited public charge consideration primarily to cash assistance for income maintenance and long-term institutionalization. Under the restored approach, officers may consider a wider range of factors and benefits, consistent with broader discretionary review.
