USCIS, No. 1:26-cv-13038 (D. Mass. July 21, 2026). The court’s order temporarily blocks several enforcement measures affecting Temporary Protected Status (TPS) beneficiaries and asylum applicants. The administrative stay remains in effect until at least August 5, 2026, pending further proceedings.
Key Details
According to the court order, USCIS is temporarily blocked from:
- Retroactively shortening TPS EAD validity
- Rejecting asylum applications solely for nonpayment of the annual fee
- Terminating employment authorization for nonpayment of the annual fee
- Initiating removal proceedings solely for nonpayment of the annual fee
The court did not block collection of the annual asylum fee. The court also did not restore the 30-day adjudication timeline for initial asylum-based employment authorization applications.

The administrative stay addresses limited issues raised in the litigation and preserves the status quo while the case proceeds. For affected individuals, the order temporarily prevents the government from enforcing the four actions listed above.
